HIPAA / Patient Information. If you are a patient, information protected by HIPAA may be governed by our Notice of Privacy Practices rather than these Terms or our website Privacy Policy. Contact us (Section 15) to obtain our NPP.
1) Eligibility & Account Responsibilities
- You must be at least 13 to use the Site. If you create an account or portal access (if offered), you must be 18 or older and provide accurate information.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
2) Permitted Use
You may access and use the Site for lawful, personal, and non-commercial purposes. You agree not to:
- Violate any applicable law or regulation.
- Infringe or misappropriate intellectual property, privacy, or other rights.
- Transmit malware, attempt to gain unauthorized access, or disrupt Site operations.
- Use bots, scrapers, or automated methods to access the Site without our written permission.

- Submit sensitive health information via general contact forms or email unless specifically requested through secure channels designated by us.

- You agree we may remove or decline to post any User Content at our discretion.

The Site may contain links to third-party websites or services we do not control. We are not responsible for their content, policies, or practices. Review the terms and privacy policies of any third-party sites you visit.
6) Communications & Electronic Notices
By providing contact information (e.g., email or mobile number), you consent to receive communications from us, including administrative and service messages.

- You agree to receive electronic notices, disclosures, and other communications, which satisfy any legal requirement that such communications be in writing.
7) Privacy
Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, and share information. For protected health information, our Notice of Privacy Practices may apply.
8) No Medical Provider-Patient Relationship via Site
Use of the Site does not create a physician-patient relationship. Such relationships, if any, arise only through direct, formal interactions with our clinicians under separate terms and consent forms.
9) Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
10) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TOTAL JOINT SOLUTIONS OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

11) Indemnification
You agree to defend, indemnify, and hold harmless Total Joint Solutions and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; or (c) your violation of any rights of another party.
12) Changes to the Site & Terms
We may modify or discontinue the Site (in whole or in part) at any time without notice. We may update these Terms from time to time; the “Effective Date” above indicates the latest revision. Your continued use of the Site after changes become effective constitutes acceptance of the updated Terms.
13) Suspension & Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Site ceases immediately.
14) Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-laws principles.
Informal Resolution. Before filing a claim, you agree to try to resolve the dispute informally by contacting us (Section 15). If we cannot resolve it within 30 days, the parties may pursue allowable remedies.
Venue. Subject to applicable law, you agree that any judicial proceeding (to the extent permitted) will be brought in the state or federal courts located in Oklahoma County, Oklahoma, and you consent to personal jurisdiction and venue in those courts.

15) Copyright & DMCA
We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a notice containing the information required by 17 U.S.C. § 512(c)(3) to our designated agent:

Upon receipt of a valid notice, we may remove or disable access to the allegedly infringing material. Repeat infringers’ access may be terminated where appropriate.
16) International Use
We operate the Site in the United States and do not represent that the Site is appropriate or available for use in other locations. Users who access the Site from outside the U.S. do so at their own risk and are responsible for compliance with local laws.
17) Miscellaneous
- Entire Agreement. These Terms, together with our Privacy Policy (and NPP where applicable), are the entire agreement between you and us regarding the Site.
- Severability. If any provision is found unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
- No Waiver. Our failure to enforce any right or provision is not a waiver of such right or provision.
- Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms at any time.
